GENERAL CONDITIONS


ACCOMODATION OFFER
article 1.
SMOKVINA is a travel agency allowed to make service as tour operator and travel agency. The service includes presentation and sale program of tourist services, accommodation resorts via Internet and other media. SMOKVINA have allowed for publish and print tourist magazines, commercials, via Internet and other media. SMOKVINA guarantee for truth of data published on web sites, printed material, posters and other media for promotion and development.
article 2.
Contract parties are SMOKVINA and Guest (can be private person or firm), who have made a reservation using official web site of SMOKVINA, printed materials or personally in SMOKVINA office. SMOKVINA guarantee for truth of content on official web site, printed materials, magazines, posters or other media. .

article 3.
Guest accepts the terms and conditions of the contract, by signing on the reservation form “I have read and accept all rights and obligation from this contract which I understand and I guarantee for truth the content filled in Reservation form”
BOOKING


article 4.
Guest makes booking application by enquiry if desired accommodation unit is available. Guest can do this procedure via fax, phone call, personally in our office or online (e-mail or enquiry form). Guest has to give all the necessary information required on the application form if he is filling in the online application or he has to show all the required documents if he is personally reserving an accommodation unit in our office.

For accommodation less than 4 days, price can be  20-40% more expenisve.
During the enquiry process SMOKVINA will check the availability of the accommodation unit.
If the accommodation unit is not available for the desired period, SMOKVINA will provide better or similar quality of accommodation. When the guest accepts the offer, SMOKVINA issues the invoice with the period reserved. The payment of the deposit can be from 35% up to 40%. .


During the booking process, guest can choose two ways of payment:
4.1. Payments to SMOKVINA (whole accommodation arrangement)
4.2. Deposit payment to SMOKVINA, and rest Guest has to pay on arrival day in our office or to owner of accommodation units.


PAYMENTS

article 5.

To confirm the reservation, Guest has to pay deposit of accommodation arrangement and send us receipt of payment via fax or e-mail.
For available accommodation, Guest may confirm the reservation within:
- 12 hours from enquiry from 1. July - 31. August
- 24 hours from enquiry from 1. May - 30.June and 1. September - 30. September
- 48 hours from enquiry from 1. October - 30. April.
If reservation has not made up to those periods, we keep right to offer desired accommodation to other clients.
If Guest uses accommodation within 7 days from the inquiry date, it is necessary to pay deposit within 4 hours from our confirmation of the accommodation and inform us via fax or e-mail, regardless of the season period.
When the deposit is received, the guest will receive the VOUCHER issued by SMOKVINA, with all necessary details of accommodation service. The prices of accommodation and other services are in Euro. For using accommodation less than 4 days, prices are 30% higher. In accommodation price, SOJOURN TAX is not included.

SOJOURN TAX
According to the Croatian Law on the Sojourn Tax, customers are required to pay the Sojourn Tax when paying for their accommodation. The Sojourn Tax in the Republic of Croatia varies from 2,00 to 7,00 KN per person per day for adults. Customers from the age of 12 to 18 have a 50% discount, while children under the age of 12 are exempt from paying. The final amount of the Sojourn Tax is determined by the destination in the Republic of Croatia and travel period, and is charged according to the General Terms and Conditions when balance payment is made. The amount of Sojourn Tax to be paid will be stated on your reservation calculation. If a country (for example, Austria) has a law defining that Sojourn Tax must be paid on the spot, the amount of Sojourn Tax will not be stated on the calculation and the guest is required to pay the amount upon arrival.



SERVICE DESCRIPTION
article 6.
Guest is obligated to give VOUCHER to owner of accommodation unit. Owner is not obligated to provide the accommodation or services, for more people than signed in VOUCHER or prolong the accommodation over arranged period.
SMOKVINA is not liable for circumstances caused by conditions beyond its control, including wars, riots, strikes, acts of terrorism, natural disasters, sanitary disruptions, restrictions by local authorities, death or illness of service provider and the like.


article 7.
SMOKVINA is not responsible for damages caused by Guests and those damages Guest has to pay to accommodation service provider.

article 8.
SMOKVINA will ensure that the kitchen in every accommodation unit is equipped with corresponding dishes and cutlery according to the number of people it is intended for. Every guest is to arrive into a clean and tidy accommodation unit, where clean bed linen will be expecting them. For the guests staying more than a week, the hosts are to change the bed linen and the towels weekly. Accommodation, food, services and other standards of particular places and countries are different and cannot be compared. If different information is given to the guest at the place the accommodation is sold, SMOKVINA is not responsible other than for the information published on its official website or printed magazines, posters etc..

CHANGES AND CANCELLATION OF BOOKING
article 9.
SMOKVINA has right to cancel confirmed reservation in extremely circumstances and in that case guest has right for money back. If cancellation occurred in case by conditions beyond its control, including wars, riots, strikes, acts of terrorism, natural disasters, sanitary disruptions, restrictions by local authorities, death or illness, amount paid to the agency will be refunded to the guest according to article 11.

article 10.
If accommodation provider cancel the reservation and it is not according to article 6. and 9. of this contract, he has obligation to offer accommodation with same or higher category and pay all expenses related for this case.


article 11.
If the guest wishes to cancel the reserved accommodation, they have to do it in writing (via email, fax or ordinary mail). Changes of booking up to 30 days before using accommodation, like different number of people or date of arrival or/and departure, first time will not be charged. Each further change will be charged in amount of 10 Euro. If the change in the reservation is impossible, and for that reason the Guest cancels the reservation, the following conditions will apply. Any such changes up to 30 days before using accommodation service, we will consider as cancellation.
The date when the agency receives the notification of the cancellation represents a basis for the calculation of cancellation charges in the following way:
-for a cancellation occurring up to 29 days before the start of using the reserved service and in the name of handling and administrative charges the agency charges 10 % of the total price of the reserved accommodation. The rest of the money is returned to the guest at the expense of the receiver.
-for a cancellation occurring from 28 to 22 days before the start of using the reserved service the agency charges 30% of the total price of the reserved accommodation. The rest of the money is returned to the guest at the expense of the receiver.

-for a cancellation occurring from 21 to 15 days before the start of using the reserved service the agency charges 60% of the total price of the reserved accommodation. The rest of the money is returned to the guest at the expense of the receiver.
- for a cancellation occurring from 14 to 8 days before the start of using the reserved service the agency charges 80% of the total price of the reserved accommodation. The rest of the money is returned to the guest at the expense of the receiver.
-for a cancellation occurring from 7 to 0 days before the start of using the reserved service the agency charges 100% of the total price of the reserved accommodation.
-if the guest does not show up at the destination or cancels the arrangement upon its beginning, the agency charges the whole amount. If the cause of the reservation cancellation is higher power on the guest's side, the agency charges only the actual costs which cannot exceed 25% of the value of the whole reservation. The rest of the amount will be returned to the guest.

LUGGAGE
article 12.
SMOKVINA is not responsible for damaged, destroyed or lost luggage, as well as for the theft of luggage or valuables in the accommodation unit (rental of a safety deposit box is recommended if available). Lost luggage or stolen goods should be reported to the host and the local police department. It is highly recommended to cover luggage in travel insurance.



article 13.
If the guest is not satisfied with the agency's solution they have a right to court arbitration. In such a case the authority in charge is the court in Solin.
